The og Companies, including the LLC’s referenced above and their respective subsidiaries (collectively, “og”) is dedicated to providing informative and useful information about its products and services through online, mobile, and other software and related systems and platforms, as well as any in-person, telephone, or other offline locations or through other aspects of og’s business (collectively, the “System”), including, without limitation, on and through the website located at www.theogcompanies.com, any mobile applications, and/or other portion of the System designated by og from time to time. As a part of the operation of the System, og gathers certain data about users.
This Data Privacy and Use Policy (“Policy”) applies to the System and governs data collection and usage at, on and through the System. Please read this Policy carefully. Each time you use, browse, or otherwise access any part of the System, you signify your acceptance of the then-current Policy, including, without limitation, the then-current terms found elsewhere on the System. If you do not agree with this Policy, you are not authorized to access or otherwise use the website, mobile application, or any other part of the System, or purchase any products from online or in-person.
This Policy is intended for individuals in the United States. If you live outside of the United States and choose to use the System connected with this Policy, you do so at your own risk and understand that your information will be sent to and stored in the United States. By using the System or otherwise providing Personal Data (as defined below) to og, you agree to this Policy. Note that there may be other websites or systems that reference the brand names used by og, but are subject to a different privacy policy.
Data Collected
You acknowledge that any personal information provided or collected through the System is voluntarily provided to og from you. As you navigate any part of the System, you will find that there are several online forms or other locations which you can use to request information regarding a specific product or service. In order for og to effectively enable the System and allow access to certain content or otherwise facilitate og’s business, og does collect and use certain data.
Two types of data are collected: (a) personal data, such as names, company names, postal addresses, e-mail addresses, telephone numbers, occupation, dates of birth, age, gender, financial information, professional contact information (e.g., employer, job title, work address, phone and/or email address), product and/or service preferences, transaction history, videos, photographs, and comments that can be used to uniquely identify or contact a single person (“Personal Data”); and (b) non-personal aggregate or traffic data, such as your IP address, which web pages or portions of the System you are visiting, the order in which the areas are visited, unique device identifier, time zone, which hyperlinks or functions are being “clicked”, how many users are visiting or accessing the System, domain server, location-based or real-time geographic location information, type of computer or device, and type of web browser (“Traffic Data” and together with Personal Data, the “Collected Data”).
Certain Personal Data we collect may be considered “Sensitive Personal Data” under applicable law, including precise geolocation data, financial account information, and certain protected characteristics where processed for purposes governed by applicable law. Where required by applicable law, we will obtain your consent prior to processing Sensitive Personal Data.
Collection and Usage
Personal Data is gathered when users provide or authorize Personal Data to or through the System, for example, when requesting information, participating in an online survey, inputting content into the System, verifying user credentials, purchasing products or services, or utilizing any other og service through the System. Personal Data is also gathered about others when users share content with family, friends, or other contacts, including, without limitation, their name, email address, phone number, and mailing address. If you submit any Personal Data relating to other people in connection with the System, you represent that you have the authority to do so and to permit og to use the information in accordance with this Policy.
Traffic Data is tracked and gathered when you and other users visit or access the System. While gathering Traffic Data may not collect Personal Data, it may provide information on the geographical location from which users access the System. Traffic Data generally does not identify individual users. Instead, the Traffic Data identifies System users as a whole, including demographic information, preferences in content and advertising, quality of service, and web and application traffic patterns.
og may, as permitted by applicable law, release and disclose the Collected Data to affiliated or contracted persons, associations, or other entities of whatsoever nature, including, without limitation, strategic alliances and advertising affiliated persons and/or entities (the “Related Parties”) or to any law enforcement agency, court, or other governmental authority to: (a) help og respond to your requests for information, goods or services and/or otherwise fulfill a user’s lawful request; (b) respond or otherwise comply with subpoenas, court orders, or other edicts of the law or legal process; (c) protect and defend og’s rights and property; or (d) to protect the personal safety of og’s users, og’s employees, or the public.
For instance, og may use your Personal Data to: (1) send you information about og and its products, updates, services, important notices, special offers, and/or upcoming promotions; (2) send you information about the Related Party’s products and services; (3) conduct surveys about your opinion of og, its staff, performance, products and services or the System; (4) verify your qualifications for certain promotions, special offers, products and services; (5) allow you to purchase goods via PayPal; and (6) customize, improve, and/or tailor your experience on the System by displaying content that og thinks you might be interested in according to your preferences.
Where appropriate, and as permitted by applicable law, og may provide notice to you. For example, og believes it may be necessary to share information with or without notice in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of the website terms of use, or as otherwise required by law.
og may, as permitted by applicable law, release and disclose the Collected Data to any persons, associations, or other entities of whatsoever nature not affiliated with og (the “Non-Affiliates”) for the purpose of facilitating your instructions, requests and/or registrations for products or services provided by og or the Non-Affiliates (including, without limitation, customer support, information technology support, PayPal processing and personal profile services) when the transfer of such Collected Data is necessary to provide you with such products or services. By selecting, instructing, requesting, reserving and/or registering for such products or services from og or the Non-Affiliates on or through the System, you consent to the release of your Collected Data to the Non-Affiliates. og shall use reasonable efforts to provide the Non-Affiliates access only to the Personal Data necessary to assist in responding to your instructions, requests, and/or registrations for such products or services and cause such Non-Affiliates to use your Personal Data for these limited purposes.
og may also disclose, release, transfer, sell, or otherwise convey any Collected Data to prospective or actual buyers, sellers or persons and/or entities related to such actions by og, including, without limitation, og may transfer information about you if og is acquired by or merges with, or otherwise sells any portion of og’s assets or equity to any other company.
You consent to any and all such conveyances of the Collected Data regardless of your location and your consent includes any and all such conveyances outside of your location, including, without limitation, in the United States and in other countries and territories.
Your Privacy Rights
Under certain circumstances, you may have rights under applicable U.S. state privacy laws regarding your Personal Data. These may include the right to:
- Receive notice pursuant to this Policy.
- Confirm whether we are processing your Personal Data.
- Request access to your Personal Data.
- Request correction of inaccuracies in your Personal Data.
- Request deletion of your Personal Data.
- Request transfer of your Personal Data in a portable format.
- Opt out from the sale of your Personal Data.
- Opt out of processing your Personal Data for targeted advertising.
- Opt out of profiling in furtherance of decisions that produce legal or similarly significant effects.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Data (or to exercise any of your other rights). This is a security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it. We may also contact you to ask for further information in relation to your request to speed up our response.
Nevada Residents: Nevada residents may request to opt out of the sale of certain covered information under Nevada law by contacting us at privacy@theogcompanies.com.
If we decline to take action regarding your request, you may appeal our decision by contacting us at privacy@theogcompanies.com within 45 days of receiving our response. We will inform you of our decision in writing within the time period required by applicable law.
You may designate an authorized agent to submit a request on your behalf, subject to verification of the agent’s authority.
Opt Out
From time to time, you may receive periodic mailings, telephone calls or e-mails from og with news or other information on og’s products and/or services. If at any time you wish to stop receiving emails or mailings, please send us an email to privacy@theogcompanies.com with the phrase “Privacy Opt-out” in the subject line, or write to us at OG Holdco LLC, Attn: Privacy Officer, 900 Work Street, Salinas, CA 93901, and we will process your opt-out request. Alternatively, for e-mail communications, you may opt out of receiving such communications by following the unsubscribe instructions set forth at the bottom of most e-mail messages from og.
If you wish to exercise rights you may have under the CCPA or CPRA, or other similar laws which may apply to you, to have your information opted-out of the sale of Collected Data by og, or to request the deletion of your information from the Collected Data, please send us an email to privacy@theogcompanies.com with the phrase “Privacy Opt-out: og, Notice of Opt-Out” in the subject line, or write to us at OG Holdco LLC, Attn: Privacy Officer, 900 Work Street, Salinas, CA 93901, and we will process your opt-out request. In processing your request, og reserves all obligations and rights it has to maintain your information as necessary for compliance with the laws of the jurisdictions in which it operates.
In the event that og wishes to transfer or release your Personal Data to a third person in a manner not set forth in this Policy, og shall inform you prior to such transfer or release and provide you with the ability to opt out of such transfer or release of Personal Data. Please contact og at privacy@theogcompanies.com if you have any questions as to how to opt out of any specific disclosures, or any marketing or other programs.
We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website at https://thenai.org/opt-out/.
Targeted Advertising and Sale/Sharing Opt-Out
We may process Personal Data for purposes of targeted advertising.
Residents of certain states have the right to opt out of the processing of Personal Data for targeted advertising or the sale or sharing of Personal Data. You may exercise these rights by:

Cookies and Related Files
og, through the System, may place small files, called ‘cookies’, onto your computer or electronic device, as well as related files, such as web beacons, pixel tags, or other means. og may use such files or Internet protocol addresses for a number of reasons, such as record keeping purposes when you visit one of our websites and/or use the System, identifying you as a unique user, simplifying the process of recording personal information (such as enabling users to not have to enter names, addresses or passwords repetitively), tracking items stored in your shopping cart, conduct research and diagnostics to improve og’s content, products, and services, preventing fraudulent activity, improving security, allowing og to better understand how users use the System and help og tailor the System or marketing message to better match needs and interests.
You may be able to program your browser to not to accept cookies or other files, but if you do, you may be unable to access some parts of the System or some parts of the System may not work properly. The ‘Help’ feature on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, how to block cookies, and when cookies will expire. If you block all cookies on your browser, neither we nor third parties will transfer cookies to your browser. If you do this, however, you may have to manually adjust some preferences every time you visit a site and some features and services may not work.
While on the System, you may receive cookies from third party advertisers or promotional entities. These cookies are outside the control of og, are not subject to the Policy, and og is not responsible for such third-party cookies.

Links to Third-Party Sites
The System may contain links to other websites or media not operated or controlled by og. These links are provided as a convenience to the visitors of the System. Since og does not operate or control linked websites or media, og cannot be responsible for the personal information collection and use policies of such linked websites or media. Therefore, you should review the privacy policy of linked websites or media prior to using or giving personal information.
For example, chat rooms, forums, message boards, links to third party websites or mobile applications (including social media websites and mobile applications), and/or news groups may be available through the System. While og will only use and disclose the Collected Data as set forth herein, any information disclosed in these areas is or may be deemed public information and you must exercise caution and discretion when deciding to disclose personal and non-personal information.
Additionally, please keep in mind that if you directly disclose Personal Data or personally sensitive data through your home page, linked sites, or other public forums, this information may be collected and used by others. og encourages all users to review the privacy statements of websites and/or mobile applications you choose to link to from the System so that you understand how those third parties collect, use and share information about you and/or your electronic devices. og is not responsible for the data collection, data usage, privacy statements or content on other websites, applications or other solutions.
Measures to Safeguard Children
og’s website is not directed or specially intended for the use of children or users under the age of 13. og encourages parents and guardians to spend time with their children online and to be fully familiar with the websites and other software visited by their children. At various places on the System, og may ask users whether they are 16 years of age or older for purposes of complying with applicable privacy laws relating to the sale or sharing of Personal Information. og relies on users to be truthful in responding to these questions. og does not knowingly collect or maintain personal information from children under 13 years of age. If og learns that personal information of a child under 16 years of age has been collected, og will take steps to delete the information as soon as possible. If you are under 13 years of age or the proper legal age, you are not allowed to use or access the System at any time or in any manner and any such use is unauthorized.
Except where required in accordance with law, law enforcement agency, court, or other governmental authority, og does not intentionally solicit Personal Data from individuals under 13 years of age. A parent or guardian whose child provided Personal Data to og without the parent’s or guardian’s consent should immediately notify og of such disclosure in writing to the contact provided below. og, upon receipt of such written notice, shall take reasonable measures to remove such disclosed information from og’s database and/or notify the appropriate authority. We do not knowingly sell or share the Personal Information of consumers under 16 years of age unless we receive affirmative authorization, as required by applicable law.
Data Security
og has implemented security measures to help protect the Personal Data. For example: (a) og stores Personal Data on servers that are in one or more physical locations that are monitored and accessible by a limited authorized set of individuals and (b) certain Collected Data is obtained through a web form and transmitted using secure socket layer (SSL) or other secure technology as may be determined by og from time to time. Although og has implemented such security measures to help protect the Personal Data, the Personal Data may still be accessed, altered, disclosed and/or otherwise used in an unauthorized manner and, as such, og cannot guarantee the security of your Personal Data from unauthorized access, alteration, disclosure and/or other impermissible uses and og is not responsible for such unauthorized access or other impermissible uses.
We retain Personal Data only for as long as reasonably necessary to fulfill the purposes for which it was collected, including to comply with legal, accounting, or reporting obligations.
California Privacy Rights and Supplemental California Privacy Notice
The California Consumer Privacy Act (“CCPA”) and California Privacy Rights Act (“CPRA”) require us to provide additional privacy-related information to residents of California. For individuals who are California residents, the law requires certain disclosures about the categories of Personal Data we collect and how we use it, the categories of sources from whom we collect Personal Data, and the third parties with whom we share it. The policies set forth in this section of our Privacy Policy apply solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and any terms defined in the CCPA have the same meaning when used in this notice.

Our Website collects information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”). In particular, og and its constitutent companies (www.theogcompanies.com) have collected the following categories of personal information from its consumers within the last twelve (12) months:

- health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data;
- personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.
og obtains the categories of personal information listed above from the following categories of sources:
- Directly from you. For example, from forms you complete or products and services you purchase.
- Indirectly from you. For example, from observing your actions on our Website.
Use of Personal Information
We may use, sell, or disclose the personal information we collect for one or more of the following business purposes:
- To fulfill or meet the reason you provided the information, such as inquiries or online applications for employment positions with og. For example, if you share your name and contact information to request a price quote or ask a question about our products or services, we will use that personal information to respond to your inquiry. If you provide your personal information to purchase a product or service, we will use that information to process your payment and facilitate delivery. - To help maintain the safety, security, and integrity of our Website, products and services, databases and other technology assets, and business.
- For testing, research, analysis, and product development, including to develop and improve our Website, products, and services.
- To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
- As described to you when collecting your personal information or as otherwise set forth in the CCPA.
- To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of og’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by og about our Website users is among the assets transferred.
og will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.
Sharing Personal Information
og may disclose your personal information to a third party for a business purpose or sell your personal information, subject to your right to opt-out of those sales (see Personal Information Sales Opt-Out and Opt-In Rights). When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract. The CCPA prohibits third parties who purchase the personal information we hold from reselling it unless you have received explicit notice and an opportunity to opt-out of further sales.
We share your personal information with the following categories of third parties:
- Service providers.
- Data aggregators.
Disclosures of Personal Information for a Business Purpose
In the preceding twelve (12) months, og and its constituent companies have disclosed the following categories of personal information for a business purpose:
Category A: Identifiers.
Category B: California Customer Records personal information categories.
We disclose your personal information for a business purpose to the following categories of third parties:
- Service providers.
- Other brands, when you enter a co-sponsored sweepstakes or contest and the rules permit us to do so.
Sales of Personal Information
In the preceding twelve (12) months, og and its constituent companies have not sold Personal Information. However, we may share Personal Information for purposes of cross-context behavioral advertising, subject to your right to opt out as described above, which may be considered a “sale” or processing for targeted advertising under applicable state privacy laws.
Your Rights and Choices
The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.
Access to Specific Information and Data Portability Rights
You have the right to request that og disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:
- The categories of personal information we collected about you.
- The categories of sources for the personal information we collected about you.
- Our business or commercial purpose for collecting or selling that personal information.
- The categories of third parties with whom we share that personal information.
- The specific pieces of personal information we collected about you (also called a data portability request).
- If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
- sales, identifying the personal information categories that each category of recipient purchased; and
- disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.
Deletion Request Rights
You have the right to request that og delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
- Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
- Debug products to identify and repair errors that impair existing intended functionality.
- Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
- Comply with a legal obligation.
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Exercising Access, Data Portability, and Deletion Rights
To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.
You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.
Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.
We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format
We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 45/90 days), we will inform you of the reason and extension period in writing.
If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Personal Information Sales Opt-Out and Opt-In Rights
If you are 16 years of age or older, you have the right to direct us to not sell your personal information at any time (the “right to opt-out”). We do not sell the personal information of consumers we actually know are less than 16 years of age, unless we receive affirmative authorization (the “right to opt-in”) from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Consumers who opt-in to personal information sales may opt-out of future sales at any time.

Do Not Sell or Share My Personal Information
Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales.
You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.
Non-Discrimination
